Speaker 2: with us about six months ago, but he's on tour
Speaker 2: again and he's going to be playing at the Rex

Speaker 2: had a really interesting conversation last time he was on
Speaker 2: and so looking forward to speaking with him again. Of course,
Speaker 2: John Poussett Dart is a legend and just a fantastic musician,
Speaker 2: but also really interesting to speak with, so looking forward
Speaker 2: to that having him back on the show. And then
Speaker 2: in the third hour, Justin Hunt will be here and
Speaker 2: he's got a very interesting story to tell as well,
Speaker 2: So we've got a big show planned ahead for you. Also,
Speaker 2: I want to mention, and I did make mention of
Speaker 2: this on social media, but this week eight years the
Speaker 2: eight year anniversary of Matt Connorton unleashed here on WMNH
Speaker 2: ninety five point three FM, right here in Manchester, and
Speaker 2: so as always, so very honored and privileged to have
Speaker 2: the opportunity to do the show here eight years. I'll
Speaker 2: tell you what go on in the blink of an eye,
Speaker 2: and of course all the all the support that we
Speaker 2: get for the show. Jenny, of course a big part
Speaker 2: of the show. She's not here with me this week.
Speaker 2: She is otherwise occupied, although I know she's listening. I
Speaker 2: see her in the chat room. But of course the
Speaker 2: past eight years not possible without Jenny, her love and
Speaker 2: support as always, and you know she does all the
Speaker 2: booking for the show too. She books all the guests
Speaker 2: and she's very organized and professional, so we really we
Speaker 2: depend on that. So so always wonderful to have Jenny here.
Speaker 2: I'm sure she'll be back next week. But she's a
Speaker 2: very big part of the show also, of course everybody
Speaker 2: here at WM and H. You know, I was texting
Speaker 2: earlier with Peter White, who not only is he the
Speaker 2: morning show host here and has been for I think,
Speaker 2: I think for Peter it's been nine years now here.
Speaker 2: Recently he celebrated his nine year anniversary at wm and AH.
Speaker 2: She's also the program director here, so he's a very
Speaker 2: important part of what keeps this whole thing going and
Speaker 2: so you know we rely on him very much. So
Speaker 2: thank you, of course to Peter White, you know, and everybody,
Speaker 2: all the other hosts here. Of course poly Ce from
Speaker 2: Retrospectrum Radio with Polyc. I'm also his co host on
Speaker 2: that show, and I love getting to do that on
Speaker 2: Friday nights, and everybody here. I almost don't want to
Speaker 2: mention everybody because I'm afraid I'll forget somebody. But you know,
Speaker 2: you've got Kyle Heavy from Off the Mark Sports, Rob
Speaker 2: has a Veto from Granted State of Mind, Rob die
Speaker 2: on from Through the Stage Door, and there's other newer programming.
Speaker 2: There's some newer things here too that hosts that I
Speaker 2: haven't even had a chance to meet yet. So you know,
Speaker 2: things continue to grow here at WMNH. It's so wonderful
Speaker 2: to be a part of this amazing station, WMNH at

Speaker 2: the Poussett Dart Band. But and of course we talked
Speaker 2: about his show coming up at the Rex Theater. Well,
Speaker 2: he's going to be calling in again today because he's
Speaker 2: got another show. He's coming back to the Rex Theater
Speaker 2: and we're going to talk about that and get caught
Speaker 2: up with him. So we really looking forward to that.

Speaker 2: controversies that are going on. For example, last week, Jenny
Speaker 2: and I talked about the controversy of Bruno Mars, not
Speaker 2: Bruno Mars himself, but one of the one of the
Speaker 2: companies that owns a Steak and the song When I
Speaker 2: Was Your Man by Bruno Mars suing Miley Cyrus and
Speaker 2: I think everyone Miley Cyrus has ever associated with over
Speaker 2: the song Flowers claiming copyright infringement and all of that.
Speaker 2: We did put the segment up on YouTube if you
Speaker 2: missed it. Kind of a very much I would say,
Speaker 2: I shouldn't say kind of very much a frivolous lawsuit
Speaker 2: in my opinion. But so we talked about these various controversies,
Speaker 2: legal issues going on in the music industry. We talk
Speaker 2: about AI a lot, all this kind of stuff, and
Speaker 2: of course, you know Jenny and I both we love
Speaker 2: a good hip hop beef. So after the well even
Speaker 2: before Kendrick Lamar's Super Bowl performance, we talked about on
Speaker 2: the show. We talked about the beef between Kendrick and Drake,
Speaker 2: which has gone back over a decade now at this
Speaker 2: point or about a decade. But so we did a
Speaker 2: long segment about that, which again is on YouTube if
Speaker 2: you want to check it out, and talking about we
Speaker 2: felt from our perspective that Kendrick had kind of put
Speaker 2: the final nail in that coffin winning that, you know,
Speaker 2: because what is a distrack ever been performed at the
Speaker 2: super Bowl. Now, maybe there is an example of that
Speaker 2: that I'm just not aware of, but that seemed like
Speaker 2: a pretty big, you know, pretty big deal. That seemed like,
Speaker 2: you know, how does Drake top that? I don't. I
Speaker 2: don't think that he does. But there's also a legal aspect,
Speaker 2: or I guess I should say a civil aspect, right,
Speaker 2: because it's not a it's not a criminal, but it
Speaker 2: is civil this lawsuit that Jake has fouled, and that
Speaker 2: aspect of it we touched on during our conversation post
Speaker 2: super Bowl performance. Jenny and I did talk about that
Speaker 2: a little bit, but we didn't get an it too
Speaker 2: deep that aspect of it. But if you don't know,
Speaker 2: Drake has filed a lawsuit against Kendrick Lamar, actually not
Speaker 2: against well, we should be precise when speaking about this,
Speaker 2: not Kendrick Lamar directly, but against Universal Music Group, who
Speaker 2: is no strangers to being sued. And we've talked about
Speaker 2: that on the show too. Months ago, we talked about
Speaker 2: the limp biscuit lawsuit against UMG. Drake is suing UMG
Speaker 2: because not only is Drake on UMG, but Kendrick Lamar
Speaker 2: is on UMG. And according to Drake, UMG kind of
Speaker 2: put their thumb on the scale in favor of Kendrick
Speaker 2: Lamar to try to devalue Drake because there is a
Speaker 2: contract negotiation coming up. Drake's contract with UMG is almost up,
Speaker 2: and Drake seems to feel that UMG, or at least
Speaker 2: a lawyers, seem to think that they can successfully sue
Speaker 2: for this. Who knows what anyone really thinks or believes, right,
Speaker 2: But you know, when there's money to be gone after
Speaker 2: this is what happens. So you know, who knows what
Speaker 2: Drake really thinks, right, but or what any of them
Speaker 2: really believe. But they think that they have a They
Speaker 2: think they have a good case to say that UMG
Speaker 2: conspired effectively with Kendrick Lamar to push this song not
Speaker 2: Like Us as a way of devaluing Drake somewhat. Now,
Speaker 2: why would if you're thinking about it logically, why would UMG?
Speaker 2: What incentive they're both on UMG? So what possible incentive
Speaker 2: would a record label like UMG have for devaluing their
Speaker 2: most successful artist Drake is I didn't even realize this
Speaker 2: until recently. Drake is the most streamed artist on Spotify,
Speaker 2: not the most streamed artist in hip hop, by the way,
Speaker 2: the most streamed artist period. I believe that still holds
Speaker 2: on Spotify. I think or is he number two? Is
Speaker 2: Taylor Swift? Actually, first, we're so used to talking about
Speaker 2: I see now I'm second guessing myself because we're so
Speaker 2: used to talking about Taylor Swift being number one and everything.
Speaker 2: But I believe Drake is number one. And why would
Speaker 2: so why would a record label with such a successful
Speaker 2: artists want to devalue them? And the explanation, which UMG
Speaker 2: denies and I'm, by the way, I find this claim
Speaker 2: dubious as well, So I'm skeptical about this. But the
Speaker 2: explanation from Drake's lawyers and why they are accusing you
Speaker 2: MG of this is that they feel that because Drake's
Speaker 2: contract is almost up, if you devalue him a little bit,
Speaker 2: you weaken Drake's negotiating position because they're gonna have to
Speaker 2: negotiate a new contract, or Drake goes elsewhere, he goes
Speaker 2: to another label, or Drake just doesn't have a label
Speaker 2: because he's already super famous. Why do you need a label?
Speaker 2: We live in an era where, you know, because of
Speaker 2: the Internet, you don't need a label. It helps if
Speaker 2: you're already famous, you've got a giant head start, right,
Speaker 2: but you don't necessarily even need a label. But if
Speaker 2: that label's going to advance you millions and millions of
Speaker 2: dollars on everything that you do, you know it can
Speaker 2: be helpful too. So that's another discussion. But so legal
Speaker 2: representation for Drake is claiming that UMG intentionally has devalued him,
Speaker 2: conspiring with Kendrick Lamar on that song Not Like Us
Speaker 2: to devalue Drake ahead of their their contract negotiations, to
Speaker 2: weaken Drake's negotiating position. Again, I'm skeptical. That seems like
Speaker 2: an awfully big gamble. Plus, you know, these conspiracies, don't,
Speaker 2: get me wrong, Conspiracies happen, of course they do, But
Speaker 2: I don't know. I don't know. Awkham's razor would suggest that, Yeah,
Speaker 2: obviously UMG wanted Kendrick to have a big hit with
Speaker 2: Not Like Us because it's on you and Kendrick is
Speaker 2: also on UMG, so they want you know, you always
Speaker 2: want to have a hit single, right and not Like
Speaker 2: Us as wildly successful. Heck, so successful it got performed
Speaker 2: at the super Bowl. Anyway, Here's here's what's There are
Speaker 2: updates with this. There are updates. This is from This
Speaker 2: is from Music Businessworldwide dot com, a very very handy
Speaker 2: website for this kind of thing. Court says discovery process
Speaker 2: can move forward and Drake's defamation lawsuit against UMG over
Speaker 2: not like US. It says here at a pre trial
Speaker 2: conference this morning in New York. And when we say
Speaker 2: this morning, we actually mean April second, so a few
Speaker 2: days ago, earlier this week. But in that conference, Judge
Speaker 2: Jeannette Vargas ruled that the discovery process in Drake's defamation
Speaker 2: lawsuit over Kendrick Lamar is not like US can begin.
Speaker 2: UMG asked the US Federal Court judge or a stay
Speaker 2: of discovery in the lawsuit on March eighteen, a day
Speaker 2: after the company filed a motion to dismiss the case.
Speaker 2: As reported last week, Drake's legal team pushed back against
Speaker 2: the request to pause the evidence gathering process. Following the
Speaker 2: decision made at this moment at this morning's pre trial conference. Again,
Speaker 2: this was earlier in the week. The discovery process for
Speaker 2: both parties can now move forward. UMG's motion to dismiss
Speaker 2: is still pending, with a hearing date set for June thirtieth.
Speaker 2: In a letter to Judge Jeannette A. Vargas filed last Wednesday,
Speaker 2: March twentieth and obtained by Music Business Worldwide, Drake's attorney
Speaker 2: Michael J. Gottlieb argued that UMG's request to freeze discovery
Speaker 2: should be denied. By the way, So, I'm not a
Speaker 2: legal expert, I have no legal background nothing, so I
Speaker 2: just I'm speaking as a layman. But if you don't know,
Speaker 2: discovery is when you get to discovery literally the evidence
Speaker 2: that is involved in the case. So if you are
Speaker 2: Drake's attorneys, you're looking for in terms of discovery, you
Speaker 2: want access to any of the documents, anything that your
Speaker 2: opponents in this case, of course, the legal representation for
Speaker 2: Kendrick Lamar or actually, I'm sorry again, we should be
Speaker 2: precise with UMG, the legal representation of UMG because they're
Speaker 2: not suing Kendrick Lamar directly unless I've misunderstood something, which
Speaker 2: is always possible, but anything, because here's what they're looking for.
Speaker 2: They want something, whether it's emails, whether it's something written
Speaker 2: down somewhere, whatever it may be. They want something. Drake's
Speaker 2: attorneys want something that shows evidence that there was a
Speaker 2: conspiracy to actually devalue Drake and thus weaken his negotiating
Speaker 2: position for the next contract. They want something that suggests that.
Speaker 2: Again I'm very skeptical about this whole theory. I find
Speaker 2: it to be a dubious claim at best, but it's possible.
Speaker 2: So that's what they're looking for. So through discovery they
Speaker 2: can get access to things that are not going to
Speaker 2: be given, not going to be offered voluntarily, right, But
Speaker 2: they can get access to all of that evidence because
Speaker 2: and again I might get some of the terminology wrong.
Speaker 2: I'm not a legal expert. I have no legal background,
Speaker 2: but from what I know, unfortunately, I've never been sued
Speaker 2: and I've never had to sue anybody, and I've gotten
Speaker 2: this far in life with avoiding all of that. But
Speaker 2: from what I understand, both parties have a right in
Speaker 2: a legal dispute, whether be it civil or criminal. Both
Speaker 2: parties have a right, in this case civil to see
Speaker 2: all of the evidence that the other party has that
Speaker 2: they're going to use in core in the case. So
Speaker 2: that's what discovery is. You're discovering what your opposition has
Speaker 2: because you have a right to be able to see
Speaker 2: that and have access to it as well. Very often
Speaker 2: the legal wrangling ends up being over what documents do
Speaker 2: you have a right to see? In terms of discovery,
Speaker 2: what do you have a right to access to? So
Speaker 2: if you're suing UMG, for example, and I know because
Speaker 2: another news story I saw, and it might be mentioned
Speaker 2: in this article, I don't know, we'll see, but I
Speaker 2: know that one of the issues that had arisen was
Speaker 2: do Drake's legal team do they have a right to
Speaker 2: access Kendrick Lamar's they're suing MG, they're not suing Kendrick directly,
Speaker 2: but do they have a right to access Kendrick Lamar's
Speaker 2: documents to see if he has any correspondence talking about
Speaker 2: a conspiracy to devalue Drake anything like that right? So,
Speaker 2: and that was a question at one point that the
Speaker 2: judge had to rule one. You know, it's one thing
Speaker 2: for them, they're suing UMG. It's one thing for them
Speaker 2: to have access to any UMG documents that they want.
Speaker 2: Do they also should they have a right to have
Speaker 2: access to Kendrick Lamar's documents or anyone else associated, anyone
Speaker 2: else who might be mixed up in this effectively, if
Speaker 2: I understand that correctly, Okay, so let me back up
Speaker 2: a little bit.
Speaker 22: So.
Speaker 2: In a letter to Judge Vargas filed on Wednesday, March twentieth,
Speaker 2: Drake's attorney argued that UMG's request to freeze discovery should
Speaker 2: be denied. Quote UMG has failed to meet its burden unquote,
Speaker 2: Gottlieb claims in the four page letter, arguing that UMG's
Speaker 2: motion to stay discovery fails on all three factors courts
Speaker 2: consider when investigating such requests. Gottlieb's letter reference to the
Speaker 2: court's own statement that quote, it is not the practice
Speaker 2: of the court to routinely stay discovery pending the outcome
Speaker 2: of emotion to dismiss un quote, highlighting that such pauses
Speaker 2: are the exception rather than the rule. The filing arrived
Speaker 2: just one day after UMG asked the court for a
Speaker 2: stay of discovery, with UMG attorney rollin a Ransom, which
Speaker 2: is such a great name. By the way, he must
Speaker 2: represent a lot of people in the music industry, because
Speaker 2: that names come up on the show before rollin a Ransom,
Speaker 2: arguing that I mean that sounds like the name of
Speaker 2: a character in a film it or a book. It
Speaker 2: doesn't sound like a real person, arguing that quote. Courts
Speaker 2: in this district have emphasized that defamation defendants must be
Speaker 2: protected from unnecessary discovery to safeguard First Amendment protections unquote.
Speaker 2: Drake's lawsuit against UMG, filed in January, alleges that the
Speaker 2: company promoted a false and malicious narrative about Drake via
Speaker 2: the context of the lyrics, single, artwork and music video
Speaker 2: for not Like Us. Today's decision over discovery is the
Speaker 2: latest development in the legal fallout from one of twenty
Speaker 2: twenty four's biggest hit. It's and a high profile wrap feud.
Speaker 2: Not Like Us was released in May twenty twenty four
Speaker 2: as part of a series of distracts exchanged between Drakes
Speaker 2: and Lamar. The development follows Drake's withdrawal of his previous
Speaker 2: legal petition against UMG and Spotify in January, which had
Speaker 2: discussed the companies, which had accused the companies of artificially
Speaker 2: inflating streams for Lamar's track By the way, what's interesting
Speaker 2: about that and that we don't have time to get
Speaker 2: into that aspect of all of this in detail, but
Speaker 2: that would be a really interesting conversation. Probably Jenny and
Speaker 2: I will tackle that in the future at some point,
Speaker 2: because I know there are a lot of strong feelings
Speaker 2: about it in terms of what is and is not
Speaker 2: appropriate or legal or ethical. Legally, I don't think there's
Speaker 2: any issue, but ethically when companies artificially inflate the numbers,
Speaker 2: and that's something that happens across the Internet, by the way,
Speaker 2: not just in streaming. You know, if say Spotify, I'll
Speaker 2: just give you a hypothetical, say, and and artists or
Speaker 2: or label is paying Spotify money to artificially inflate the
Speaker 2: numbers of a particular single from a particular artist, so
Speaker 2: that when you look at that on Spotify it looks
Speaker 2: like it's got a lot more listens than it actually does.
Speaker 2: Is that ethical? Is that okay? Or is that a
Speaker 2: form of payola? And again we can have a whole
Speaker 2: that's a whole separate conversation because I know a lot
Speaker 2: of people have feelings about that. But when when I
Speaker 2: say that happens across the Internet, that happens to other
Speaker 2: places too. What happens with podcasts, it happens with everything.
Speaker 2: For example, on on X formerly Twitter, sometimes people will
Speaker 2: put videos or live streams on X and then they'll
Speaker 2: be talking about you know, look at how successful this was,
Speaker 2: and look at all the people who watched my video,
Speaker 2: when in reality, anybody who even scrolls past that video,
Speaker 2: even if they don't watch more than a second of it,
Speaker 2: you know, that counts as a quote unquote view of
Speaker 2: the video. So the numbers are artificially inflated that way,
Speaker 2: or Rumble does that. Rumble is notorious for doing that.
Speaker 2: They inflate their numbers to make their context content creators
Speaker 2: happy and make them look more successful and so forth.
Speaker 2: But there is more to this article, but we are
