35:10 Speaker 2: controversies that are going on. For example, last week, Jenny

35:12 Speaker 2: and I talked about the controversy of Bruno Mars, not

35:16 Speaker 2: Bruno Mars himself, but one of the one of the

35:20 Speaker 2: companies that owns a Steak and the song When I

35:22 Speaker 2: Was Your Man by Bruno Mars suing Miley Cyrus and

35:26 Speaker 2: I think everyone Miley Cyrus has ever associated with over

35:29 Speaker 2: the song Flowers claiming copyright infringement and all of that.

35:32 Speaker 2: We did put the segment up on YouTube if you

35:33 Speaker 2: missed it. Kind of a very much I would say,

35:37 Speaker 2: I shouldn't say kind of very much a frivolous lawsuit

35:40 Speaker 2: in my opinion. But so we talked about these various controversies,

35:44 Speaker 2: legal issues going on in the music industry. We talk

35:46 Speaker 2: about AI a lot, all this kind of stuff, and

35:48 Speaker 2: of course, you know Jenny and I both we love

35:51 Speaker 2: a good hip hop beef. So after the well even

35:56 Speaker 2: before Kendrick Lamar's Super Bowl performance, we talked about on

36:00 Speaker 2: the show. We talked about the beef between Kendrick and Drake,

36:03 Speaker 2: which has gone back over a decade now at this

36:06 Speaker 2: point or about a decade. But so we did a

36:11 Speaker 2: long segment about that, which again is on YouTube if

36:13 Speaker 2: you want to check it out, and talking about we

36:19 Speaker 2: felt from our perspective that Kendrick had kind of put

36:22 Speaker 2: the final nail in that coffin winning that, you know,

36:25 Speaker 2: because what is a distrack ever been performed at the

36:29 Speaker 2: super Bowl. Now, maybe there is an example of that

36:31 Speaker 2: that I'm just not aware of, but that seemed like

36:33 Speaker 2: a pretty big, you know, pretty big deal. That seemed like,

36:36 Speaker 2: you know, how does Drake top that? I don't. I

36:40 Speaker 2: don't think that he does. But there's also a legal aspect,

36:44 Speaker 2: or I guess I should say a civil aspect, right,

36:46 Speaker 2: because it's not a it's not a criminal, but it

36:48 Speaker 2: is civil this lawsuit that Jake has fouled, and that

36:52 Speaker 2: aspect of it we touched on during our conversation post

36:55 Speaker 2: super Bowl performance. Jenny and I did talk about that

36:58 Speaker 2: a little bit, but we didn't get an it too

37:00 Speaker 2: deep that aspect of it. But if you don't know,

37:03 Speaker 2: Drake has filed a lawsuit against Kendrick Lamar, actually not

37:08 Speaker 2: against well, we should be precise when speaking about this,

37:11 Speaker 2: not Kendrick Lamar directly, but against Universal Music Group, who

37:16 Speaker 2: is no strangers to being sued. And we've talked about

37:19 Speaker 2: that on the show too. Months ago, we talked about

37:22 Speaker 2: the limp biscuit lawsuit against UMG. Drake is suing UMG

37:27 Speaker 2: because not only is Drake on UMG, but Kendrick Lamar

37:32 Speaker 2: is on UMG. And according to Drake, UMG kind of

37:38 Speaker 2: put their thumb on the scale in favor of Kendrick

37:41 Speaker 2: Lamar to try to devalue Drake because there is a

37:46 Speaker 2: contract negotiation coming up. Drake's contract with UMG is almost up,

37:50 Speaker 2: and Drake seems to feel that UMG, or at least

37:55 Speaker 2: a lawyers, seem to think that they can successfully sue

37:59 Speaker 2: for this. Who knows what anyone really thinks or believes, right,

38:03 Speaker 2: But you know, when there's money to be gone after

38:08 Speaker 2: this is what happens. So you know, who knows what

38:10 Speaker 2: Drake really thinks, right, but or what any of them

38:13 Speaker 2: really believe. But they think that they have a They

38:16 Speaker 2: think they have a good case to say that UMG

38:20 Speaker 2: conspired effectively with Kendrick Lamar to push this song not

38:24 Speaker 2: Like Us as a way of devaluing Drake somewhat. Now,

38:29 Speaker 2: why would if you're thinking about it logically, why would UMG?

38:35 Speaker 2: What incentive they're both on UMG? So what possible incentive

38:40 Speaker 2: would a record label like UMG have for devaluing their

38:45 Speaker 2: most successful artist Drake is I didn't even realize this

38:49 Speaker 2: until recently. Drake is the most streamed artist on Spotify,

38:53 Speaker 2: not the most streamed artist in hip hop, by the way,

38:55 Speaker 2: the most streamed artist period. I believe that still holds

38:58 Speaker 2: on Spotify. I think or is he number two? Is

39:02 Speaker 2: Taylor Swift? Actually, first, we're so used to talking about

39:07 Speaker 2: I see now I'm second guessing myself because we're so

39:09 Speaker 2: used to talking about Taylor Swift being number one and everything.

39:16 Speaker 2: But I believe Drake is number one. And why would

39:22 Speaker 2: so why would a record label with such a successful

39:25 Speaker 2: artists want to devalue them? And the explanation, which UMG

39:28 Speaker 2: denies and I'm, by the way, I find this claim

39:30 Speaker 2: dubious as well, So I'm skeptical about this. But the

39:33 Speaker 2: explanation from Drake's lawyers and why they are accusing you

39:38 Speaker 2: MG of this is that they feel that because Drake's

39:42 Speaker 2: contract is almost up, if you devalue him a little bit,

39:47 Speaker 2: you weaken Drake's negotiating position because they're gonna have to

39:51 Speaker 2: negotiate a new contract, or Drake goes elsewhere, he goes

39:53 Speaker 2: to another label, or Drake just doesn't have a label

39:56 Speaker 2: because he's already super famous. Why do you need a label?

40:00 Speaker 2: We live in an era where, you know, because of

40:03 Speaker 2: the Internet, you don't need a label. It helps if

40:05 Speaker 2: you're already famous, you've got a giant head start, right,

40:09 Speaker 2: but you don't necessarily even need a label. But if

40:13 Speaker 2: that label's going to advance you millions and millions of

40:15 Speaker 2: dollars on everything that you do, you know it can

40:17 Speaker 2: be helpful too. So that's another discussion. But so legal

40:23 Speaker 2: representation for Drake is claiming that UMG intentionally has devalued him,

40:27 Speaker 2: conspiring with Kendrick Lamar on that song Not Like Us

40:31 Speaker 2: to devalue Drake ahead of their their contract negotiations, to

40:35 Speaker 2: weaken Drake's negotiating position. Again, I'm skeptical. That seems like

40:40 Speaker 2: an awfully big gamble. Plus, you know, these conspiracies, don't,

40:45 Speaker 2: get me wrong, Conspiracies happen, of course they do, But

40:48 Speaker 2: I don't know. I don't know. Awkham's razor would suggest that, Yeah,

40:56 Speaker 2: obviously UMG wanted Kendrick to have a big hit with

40:58 Speaker 2: Not Like Us because it's on you and Kendrick is

41:01 Speaker 2: also on UMG, so they want you know, you always

41:04 Speaker 2: want to have a hit single, right and not Like

41:06 Speaker 2: Us as wildly successful. Heck, so successful it got performed

41:10 Speaker 2: at the super Bowl. Anyway, Here's here's what's There are

41:14 Speaker 2: updates with this. There are updates. This is from This

41:21 Speaker 2: is from Music Businessworldwide dot com, a very very handy

41:24 Speaker 2: website for this kind of thing. Court says discovery process

41:28 Speaker 2: can move forward and Drake's defamation lawsuit against UMG over

41:31 Speaker 2: not like US. It says here at a pre trial

41:35 Speaker 2: conference this morning in New York. And when we say

41:39 Speaker 2: this morning, we actually mean April second, so a few

41:43 Speaker 2: days ago, earlier this week. But in that conference, Judge

41:50 Speaker 2: Jeannette Vargas ruled that the discovery process in Drake's defamation

41:54 Speaker 2: lawsuit over Kendrick Lamar is not like US can begin.

41:57 Speaker 2: UMG asked the US Federal Court judge or a stay

42:01 Speaker 2: of discovery in the lawsuit on March eighteen, a day

42:04 Speaker 2: after the company filed a motion to dismiss the case.

42:08 Speaker 2: As reported last week, Drake's legal team pushed back against

42:11 Speaker 2: the request to pause the evidence gathering process. Following the

42:15 Speaker 2: decision made at this moment at this morning's pre trial conference. Again,

42:18 Speaker 2: this was earlier in the week. The discovery process for

42:21 Speaker 2: both parties can now move forward. UMG's motion to dismiss

42:26 Speaker 2: is still pending, with a hearing date set for June thirtieth.

42:30 Speaker 2: In a letter to Judge Jeannette A. Vargas filed last Wednesday,

42:34 Speaker 2: March twentieth and obtained by Music Business Worldwide, Drake's attorney

42:39 Speaker 2: Michael J. Gottlieb argued that UMG's request to freeze discovery

42:43 Speaker 2: should be denied. By the way, So, I'm not a

42:46 Speaker 2: legal expert, I have no legal background nothing, so I

42:50 Speaker 2: just I'm speaking as a layman. But if you don't know,

42:54 Speaker 2: discovery is when you get to discovery literally the evidence

43:02 Speaker 2: that is involved in the case. So if you are

43:06 Speaker 2: Drake's attorneys, you're looking for in terms of discovery, you

43:10 Speaker 2: want access to any of the documents, anything that your

43:17 Speaker 2: opponents in this case, of course, the legal representation for

43:20 Speaker 2: Kendrick Lamar or actually, I'm sorry again, we should be

43:23 Speaker 2: precise with UMG, the legal representation of UMG because they're

43:27 Speaker 2: not suing Kendrick Lamar directly unless I've misunderstood something, which

43:31 Speaker 2: is always possible, but anything, because here's what they're looking for.

43:37 Speaker 2: They want something, whether it's emails, whether it's something written

43:41 Speaker 2: down somewhere, whatever it may be. They want something. Drake's

43:46 Speaker 2: attorneys want something that shows evidence that there was a

43:51 Speaker 2: conspiracy to actually devalue Drake and thus weaken his negotiating

43:55 Speaker 2: position for the next contract. They want something that suggests that.

44:02 Speaker 2: Again I'm very skeptical about this whole theory. I find

44:07 Speaker 2: it to be a dubious claim at best, but it's possible.

44:13 Speaker 2: So that's what they're looking for. So through discovery they

44:16 Speaker 2: can get access to things that are not going to

44:20 Speaker 2: be given, not going to be offered voluntarily, right, But

44:23 Speaker 2: they can get access to all of that evidence because

44:26 Speaker 2: and again I might get some of the terminology wrong.

44:29 Speaker 2: I'm not a legal expert. I have no legal background,

44:32 Speaker 2: but from what I know, unfortunately, I've never been sued

44:36 Speaker 2: and I've never had to sue anybody, and I've gotten

44:39 Speaker 2: this far in life with avoiding all of that. But

44:42 Speaker 2: from what I understand, both parties have a right in

44:48 Speaker 2: a legal dispute, whether be it civil or criminal. Both

44:51 Speaker 2: parties have a right, in this case civil to see

44:54 Speaker 2: all of the evidence that the other party has that

44:57 Speaker 2: they're going to use in core in the case. So

45:01 Speaker 2: that's what discovery is. You're discovering what your opposition has

45:05 Speaker 2: because you have a right to be able to see

45:08 Speaker 2: that and have access to it as well. Very often

45:11 Speaker 2: the legal wrangling ends up being over what documents do

45:16 Speaker 2: you have a right to see? In terms of discovery,

45:18 Speaker 2: what do you have a right to access to? So

45:21 Speaker 2: if you're suing UMG, for example, and I know because

45:24 Speaker 2: another news story I saw, and it might be mentioned

45:26 Speaker 2: in this article, I don't know, we'll see, but I

45:28 Speaker 2: know that one of the issues that had arisen was

45:33 Speaker 2: do Drake's legal team do they have a right to

45:38 Speaker 2: access Kendrick Lamar's they're suing MG, they're not suing Kendrick directly,

45:43 Speaker 2: but do they have a right to access Kendrick Lamar's

45:46 Speaker 2: documents to see if he has any correspondence talking about

45:53 Speaker 2: a conspiracy to devalue Drake anything like that right? So,

45:57 Speaker 2: and that was a question at one point that the

45:59 Speaker 2: judge had to rule one. You know, it's one thing

46:02 Speaker 2: for them, they're suing UMG. It's one thing for them

46:04 Speaker 2: to have access to any UMG documents that they want.

46:07 Speaker 2: Do they also should they have a right to have

46:10 Speaker 2: access to Kendrick Lamar's documents or anyone else associated, anyone

46:14 Speaker 2: else who might be mixed up in this effectively, if

46:17 Speaker 2: I understand that correctly, Okay, so let me back up

46:24 Speaker 2: a little bit.

46:24 Speaker 22: So.

46:25 Speaker 2: In a letter to Judge Vargas filed on Wednesday, March twentieth,

46:29 Speaker 2: Drake's attorney argued that UMG's request to freeze discovery should

46:33 Speaker 2: be denied. Quote UMG has failed to meet its burden unquote,

46:38 Speaker 2: Gottlieb claims in the four page letter, arguing that UMG's

46:42 Speaker 2: motion to stay discovery fails on all three factors courts

46:47 Speaker 2: consider when investigating such requests. Gottlieb's letter reference to the

46:51 Speaker 2: court's own statement that quote, it is not the practice

46:54 Speaker 2: of the court to routinely stay discovery pending the outcome

46:58 Speaker 2: of emotion to dismiss un quote, highlighting that such pauses

47:02 Speaker 2: are the exception rather than the rule. The filing arrived

47:06 Speaker 2: just one day after UMG asked the court for a

47:08 Speaker 2: stay of discovery, with UMG attorney rollin a Ransom, which

47:13 Speaker 2: is such a great name. By the way, he must

47:15 Speaker 2: represent a lot of people in the music industry, because

47:18 Speaker 2: that names come up on the show before rollin a Ransom,

47:23 Speaker 2: arguing that I mean that sounds like the name of

47:26 Speaker 2: a character in a film it or a book. It

47:27 Speaker 2: doesn't sound like a real person, arguing that quote. Courts

47:30 Speaker 2: in this district have emphasized that defamation defendants must be

47:35 Speaker 2: protected from unnecessary discovery to safeguard First Amendment protections unquote.

47:41 Speaker 2: Drake's lawsuit against UMG, filed in January, alleges that the

47:45 Speaker 2: company promoted a false and malicious narrative about Drake via

47:50 Speaker 2: the context of the lyrics, single, artwork and music video

47:53 Speaker 2: for not Like Us. Today's decision over discovery is the

47:56 Speaker 2: latest development in the legal fallout from one of twenty

47:59 Speaker 2: twenty four's biggest hit. It's and a high profile wrap feud.

48:02 Speaker 2: Not Like Us was released in May twenty twenty four

48:04 Speaker 2: as part of a series of distracts exchanged between Drakes

48:07 Speaker 2: and Lamar. The development follows Drake's withdrawal of his previous

48:11 Speaker 2: legal petition against UMG and Spotify in January, which had

48:17 Speaker 2: discussed the companies, which had accused the companies of artificially

48:21 Speaker 2: inflating streams for Lamar's track By the way, what's interesting

48:29 Speaker 2: about that and that we don't have time to get

48:32 Speaker 2: into that aspect of all of this in detail, but

48:34 Speaker 2: that would be a really interesting conversation. Probably Jenny and

48:37 Speaker 2: I will tackle that in the future at some point,

48:40 Speaker 2: because I know there are a lot of strong feelings

48:42 Speaker 2: about it in terms of what is and is not

48:47 Speaker 2: appropriate or legal or ethical. Legally, I don't think there's

48:52 Speaker 2: any issue, but ethically when companies artificially inflate the numbers,

48:58 Speaker 2: and that's something that happens across the Internet, by the way,

49:00 Speaker 2: not just in streaming. You know, if say Spotify, I'll

49:05 Speaker 2: just give you a hypothetical, say, and and artists or

49:08 Speaker 2: or label is paying Spotify money to artificially inflate the

49:15 Speaker 2: numbers of a particular single from a particular artist, so

49:19 Speaker 2: that when you look at that on Spotify it looks

49:23 Speaker 2: like it's got a lot more listens than it actually does.

49:29 Speaker 2: Is that ethical? Is that okay? Or is that a

49:32 Speaker 2: form of payola? And again we can have a whole

49:35 Speaker 2: that's a whole separate conversation because I know a lot

49:41 Speaker 2: of people have feelings about that. But when when I

49:43 Speaker 2: say that happens across the Internet, that happens to other

49:46 Speaker 2: places too. What happens with podcasts, it happens with everything.

49:48 Speaker 2: For example, on on X formerly Twitter, sometimes people will

49:57 Speaker 2: put videos or live streams on X and then they'll

49:59 Speaker 2: be talking about you know, look at how successful this was,

50:02 Speaker 2: and look at all the people who watched my video,

50:04 Speaker 2: when in reality, anybody who even scrolls past that video,

50:09 Speaker 2: even if they don't watch more than a second of it,

50:12 Speaker 2: you know, that counts as a quote unquote view of

50:14 Speaker 2: the video. So the numbers are artificially inflated that way,

50:20 Speaker 2: or Rumble does that. Rumble is notorious for doing that.

50:23 Speaker 2: They inflate their numbers to make their context content creators

50:26 Speaker 2: happy and make them look more successful and so forth.
