Speaker 9: And then we've got a couple of Uh, we'll see

Speaker 9: couple of world radio premieres to feature this week. We
Speaker 9: did it in the first hour, but if you miss it,

Speaker 9: look at this. This is from music Businessworldwide dot com,
Speaker 9: one of my favorite websites for music industry news, which
Speaker 9: we do a lot of here on the show. But
Speaker 9: this story caught my eye, not only because it's some
Speaker 9: very interesting music industry news and the base of the
Speaker 9: story is interesting for a couple of reasons, but it's
Speaker 9: also one of these things where you go, why would
Speaker 9: anyone try to do this and think that they can
Speaker 9: get away with it? Yes, this story does involve a
Speaker 9: fraud and much of fraud. It's like why does why
Speaker 9: does anyone think that they're going to get away with this?
Speaker 9: It's like bank robberies. You know, you ever you ever
Speaker 9: hear or see a news story about a bank robbery
Speaker 9: in twenty twenty six, and you think, why does anyone
Speaker 9: think that they can rob a bank and they're going
Speaker 9: to somehow get away with it. It's not gonna happen.
Speaker 9: You're not gonna get away with robbing a bank. So
Speaker 9: this is one of those things you ready for this.
Speaker 9: Napster's three billion dollar investor charged with fraud, as US
Speaker 9: authorities say the money never existed. Oops, somebody thought they
Speaker 9: were gonna get away with it. I guess I don't know.
Speaker 9: I don't know what they were trying to do. Let's
Speaker 9: look at this and again, this is from Music Businessworldwide
Speaker 9: dot com says your US authorities have charged a North
Speaker 9: Carolina man with fraud, alleging that he used forged bank
Speaker 9: records and a fake banking website to obtain hundreds of
Speaker 9: millions of shares in Napster owner Infinite Infinite Reality without
Speaker 9: paying a cent. An indictment, unsealed on Thursday, June eleven,
Speaker 9: charges that Charles Cole of Mooresville, North Carolina, with wire fraud,
Speaker 9: conspiracy to commit wire fraud, and conspiracy to commit securities fraud.
Speaker 9: That's a lot of fraud. He also faces a parallel
Speaker 9: civil complaint from the US Securities and Exchange Commission the SEC,
Speaker 9: which charges him alongside his lawyer, attorney Torbin Welch, with
Speaker 9: and three entities he controlled. Okay, so that's where the
Speaker 9: conspiracy part of the fraud comes in. The fraud part
Speaker 9: is clear. Now, we also know where the conspiracy is.
Speaker 9: The case centers on Infinite Reality, the Florida based technology
Speaker 9: company that acquired Napster in twenty twenty five and later
Speaker 9: took on its name. In mid twenty twenty four, the
Speaker 9: company was seeking to raise around three hundred and fifty
Speaker 9: million dollars, and a broker introduced it to Coal as
Speaker 9: someone who could help facilitate the investment. The indictment states
Speaker 9: Cole first proposed handing over a one billion dollar bond
Speaker 9: in exchange for three hundred and fifty million dollars of stock,
Speaker 9: but his attempts to monetize it failed. He then told
Speaker 9: the company he wanted to buy billions of dollars worth
Speaker 9: of shares, directly submitting documents if falsely claimed a fifty
Speaker 9: million dollar annual income and an eight hundred million dollar
Speaker 9: net worth. Prosecutors allege again, there's more to this, but again,
Speaker 9: I just whenever I see something or hear something like this,
Speaker 9: it's like, how did this person think they were going
Speaker 9: to get away with this? Cole and Welch falsely told
Speaker 9: Infinite Reality that Coal or Avnok controlled at least fifty
Speaker 9: five billion dollars in assets. The sec alleges. When payments
Speaker 9: failed to arrive, Cole allegedly told Infinite Reality that he
Speaker 9: held billions of dollars at a second bank, this one
Speaker 9: in Malaysia, and that he had opened an account there
Speaker 9: in the company's name. One fabricated letter claimed Cole was
Speaker 9: quote ready, willing and able to fully fund the transfer
Speaker 9: of how do I even read this three billion, three
Speaker 9: hundred and sixty million dollars. According to the indictment, the account, however,
Speaker 9: was a fiction. Coal and a co conspirator had a step.
Speaker 9: By the way, what's the what's the point of the
Speaker 9: word co conspirator? Can't you just say conspirator? A conspiracy
Speaker 9: has to have more than one person, So why do
Speaker 9: we need co conspirator? Why can't we just say conspirator?
Speaker 9: What's the difference? Sorry, longtime listeners know, I get fixated
Speaker 9: on things like that. Cole and a co conspirator had
Speaker 9: established offshore servers hosting a fake website that mirrored the
Speaker 9: real banks site, allowing users to quote log in to
Speaker 9: fabricated accounts. The indictment states Cole repeatedly asked a Cone
Speaker 9: a co conspirator, whether the server hosting the mirror was
Speaker 9: up and running so that we can add an account
Speaker 9: and go live. According to the indictment, Infinite Reality executives
Speaker 9: received a fake welcome email, logged in and saw what
Speaker 9: looked like a funded account. Prosecutors allege in all if
Speaker 9: Finite Reality issued Cole and his entities at least two
Speaker 9: hundred and thirty nine million shares. The indictment states. Jake Clayton,
Speaker 9: us attorney, said, quote as alleged, Charles Cole built a
Speaker 9: fiction of wealth using fake bank records, sham correspondence, and
Speaker 9: a fraudulent bank website, then use that fiction to obtain
Speaker 9: hundreds of millions of shares with no intention of paying
Speaker 9: for them unquote. He also said, quote fraud is flaw.
Speaker 9: A fraud is flaw, a fraud, whether in our public
Speaker 9: markets or our private markets unquote. By the way, I
Speaker 9: assume he's saying that, because I mean, and that should
Speaker 9: be obvious frauds fraud. But you know, there are people
Speaker 9: and I'm not someone who does this, but there are
Speaker 9: people who will take the perspective of and you see
Speaker 9: this more and more of well, it's just somebody stealing
Speaker 9: from a big company, so that that makes it okay.
Speaker 9: People will kind of justify that that makes it okay
Speaker 9: if you're ripping off big company, you're ripping off a
Speaker 9: corporation who cares. But again, fraud is fraud, and that
Speaker 9: might be a good thing to remind people like this guy,
Speaker 9: Charles Cole, who again, how did he think that he
Speaker 9: wasn't going to get caught? Kenny On's an unusual name.
Speaker 9: Kenny larco Ward, the inspector in charge of the New
Speaker 9: York Field office of the US Postal Inspection Service, said, quote,
Speaker 9: mister Cole allegedly defrauded an unsuspecting company through a series
Speaker 9: of lies and misrepresentations unquote. It says here Cole never
Speaker 9: invested any money and instead used the shares as collateral
Speaker 9: to borrow from lenders. The indictment states, in May twenty
Speaker 9: twenty five, a US lender loaned one million dollars against
Speaker 9: nearly forty five million of the shares, with the proceeds
Speaker 9: passing through an account held by Cole's then attorney before
Speaker 9: roughly two hundred and eighty thousand was withdrawn. The SEC
Speaker 9: identified that attorney as Welch In alleges that he secured
Speaker 9: the loan by providing forged documents to verify Cole's wealth
Speaker 9: and giving the lender false assurances. Cole later like, what's
Speaker 9: the point of all? Like, is it just again? I
Speaker 9: know I'm editorializing a lot here, but I just I
Speaker 9: wonder about this. Are these people just crazy? These conspirators,
Speaker 9: They couldn't, Like, no rational human being could possibly think
Speaker 9: that they're going to get away with this. Anything that
Speaker 9: you do leaves a digital footprint, leaves breadcrumbs. You can't
Speaker 9: possibly get away with anything like this. You can't. And
Speaker 9: I'm sure somewhere there's a story of someone who pulled
Speaker 9: off a grandiose scheme like this and got away with it. Okay,
Speaker 9: but the odds are so incredibly low. I mean, how
Speaker 9: did these people think they had a shot at getting
Speaker 9: away with this? They have to be insane. These are
Speaker 9: not mentally well people to even attempt this scheme. In
Speaker 9: my opinion, it says here and again this is from
Speaker 9: a music businessworldwide dot com. Cole later tried to acquire
Speaker 9: still more shares through a tender offer, fabricating a screenshot
Speaker 9: of an eleven billion dollar balance and an account that
Speaker 9: did not exist. Prosecutors alleged Cole even directed a co
Speaker 9: conspirator to fix mismatched formatting on the forged statements so
Speaker 9: they would match all the others, according to the indictment.
Speaker 9: The scheme unraveled in March twenty twenty six when Infinite
Speaker 9: Reality rescinded all the shares it had issued to Coal
Speaker 9: and his entities. As Music Business Worldwide reported in March
Speaker 9: twenty twenty five, Infinite Reality acquired Napster in a two
Speaker 9: hundred and seven million dollar deal, weeks after announcing what
Speaker 9: it described as a three billion dollar funding round from
Speaker 9: an unnamed private investor. The money never arrived, and prosecutors
Speaker 9: now led to the investor behind it, Cole, never had
Speaker 9: the funds he promised. Napster launched in nineteen ninety nine
Speaker 9: as a file sharing service before being shut down following
Speaker 9: a wave of copyright lawsuits, and the brand has changed
Speaker 9: hands repeatedly as a licensed streaming service and by the way,
Speaker 9: Napster again. When we talk about, you know, the changes
Speaker 9: in the music industry and everything right now, the big
Speaker 9: change is AI AI is causing a lot of upheopal
Speaker 9: in the music industry. But back then, in nineteen ninety
Speaker 9: nine into the early two thousands, it was Napster. I
Speaker 9: was working for Transworld Entertainment at the time. I was
Speaker 9: a store manager. Trans World owned at that time Strawberries,
Speaker 9: which eventually got bought. Well actually this was before trans
Speaker 9: World owned it. Strawberries was a separate company. But anyway,
Speaker 9: it was a music store, so we sold CDs and
Speaker 9: Jesus at that time we staw had cassette tapes, but
Speaker 9: we were mostly selling CDs, so we were selling music.
Speaker 9: So when Napster showed up, like there was an and
Speaker 9: this is not hyperbolic, this is absolute fact. There was
Speaker 9: what could only be described as panic in the industry,
Speaker 9: both on the retail side of it and all throughout
Speaker 9: the music industry. There was panic because it was like
Speaker 9: Napster comes along, and you can and it was the
Speaker 9: harbinger of what we have now. But you know, the
Speaker 9: music industry really had to adapt here, and it took
Speaker 9: a long time, but there was panic. Napster comes along,
Speaker 9: and I remember having conversations with people about this where
Speaker 9: I said, you know, so I guess music is just free.
Speaker 9: Now music is free, so this changes everything And there
Speaker 9: was absolute panic, all right, So it was my little
Speaker 9: Napster sidebar. It says here. In twenty eleven it merged
Speaker 9: with the subscription platform Rhapsody, and operated under the Rhapsody
Speaker 9: name in the US until rebranding re rebranding to Napster
Speaker 9: again in twenty sixteen. It was sold to virtual reality
Speaker 9: company Melody VR in a seven million dollars deal in
Speaker 9: twenty twenty, then to hive Mind Capital Partners and cryptocurrency
Speaker 9: firm Algorand in twenty twenty two before the Infinite Reality
Speaker 9: acquisition in twenty twenty five. The case has been assigned
Speaker 9: to US District Court Judge Vernon S. Broderick, with Cole
Speaker 9: presented in the Western District of North Carolina on Thursday.
Speaker 9: The wire fraud and wire fraud conspiracy counts each carry
Speaker 9: a maximum sentence of twenty years in prison, while the
Speaker 9: securities fraud conspiracy counts carry a maximum of five years.
Speaker 9: The DOJ said. The full indictment also seeks the forfeiture
Speaker 9: if any proceeds col made from the alleged scheme. The
Speaker 9: charges are allegations, and Cole is presented innocent is I'm sorry,
Speaker 9: presumed innocent until and unless proven guilty. So there you go.
Speaker 9: But again, like, how does somebody do this and think
Speaker 9: that they have any shot of getting away with it.
Speaker 9: It's it's truly, truly remarkable. If you are just joining us,

Speaker 9: Musicnews dot Com, again one of my favorite websites for
Speaker 9: music industry news, and this relates to something that we
Speaker 9: were talking on the show about very recently. You know,
Speaker 9: because in the AI era and as we watch how
Speaker 9: AI is affecting the music industry or infecting the music
Speaker 9: industry depending on your point of view, there's a and
Speaker 9: again we were even talking about this. Well, we touched
Speaker 9: on on this a little bit with UH with Mick
Speaker 9: from Corners of Sanctuary, in the first hour. But AI
Speaker 9: is really causing a lot of One of the things
Speaker 9: that people are concerned with with AI, it's not just
Speaker 9: that you're able to easily generate really professional, well produced
Speaker 9: music with just a few prompts, like with apps like
Speaker 9: Suno and whatnot. So obviously people are concerned about musicians
Speaker 9: being replaced by AI. You know, a lot of people
Speaker 9: are worried about their jobs losing their jobs to AI
Speaker 9: in various ways as we see the acceleration of automation
Speaker 9: and all of these things. But you wouldn't necessarily if
Speaker 9: it's not something that if the music industry isn't something

Speaker 9: music industry in any capacity, you are thinking about this.
Speaker 9: But there's also an increased potential for fraud for people
Speaker 9: pretending to be who they're not, impersonating celebrities. We talked
Speaker 9: about that recently on the show on TikTok Ai impersonations
Speaker 9: of Taylor Swift, for example, selling memberships to some service
Speaker 9: on TikTok And then you wonder, well, if you're a
Speaker 9: discerning person using logic and reason, you might wonder, why
Speaker 9: would Taylor Swift, who has all the money in the
Speaker 9: world and is so hugely successful, a global icon, why
Speaker 9: is she on tiko talk selling memberships? Because it's not
Speaker 9: really Taylor Swift. It's AI generated, but it's it wants
Speaker 9: you to think it's Taylor Swift. It's fraud. So Spotify,
Speaker 9: we talked about this on the show. Spotify has they've
Speaker 9: got this new artist profile protection thing where if you're
Speaker 9: an artist on Spotify, if you have music on Spotify,
Speaker 9: you can become verified. It's similar to what other social
Speaker 9: media platforms have done, like you know x formerly Twitter
Speaker 9: you can be verified. You can do something like that
Speaker 9: on Facebook now too. For your business you can be verified.
Speaker 9: I don't know if Facebook calls it verified or if
Speaker 9: they call it something else. I can't remember, but it
Speaker 9: costs money, so I haven't done it. But now they
Speaker 9: have it for artists, so you can be a verified artist.
Speaker 9: And what this is supposed to prevent In theory, is
Speaker 9: somebody say, somebody wants to pretend that they're Tailor's Swift
Speaker 9: and they create some music, presumably during using AI, some
Speaker 9: AI generated tracks that sound like Taylor Swift, and then
Speaker 9: they upload them to Spotify and they call themselves Taylor Swift,
Speaker 9: but they're not really Taylor Swift. It's supposed to help
Speaker 9: to prevent that, but is it working? And this question
Speaker 9: this article asks that question from Digital Musicnews dot com.

Speaker 9: Bridget Mendler's new EP appears. So let's see what's going
Speaker 9: on here, it says. Bridget Mendler says a SURPRISEEP attributed
Speaker 9: to her on Spotify and Apple Music is not her,
Speaker 9: raising questions about streaming platforms efforts to curb AI impersonators.
Speaker 9: Last week, fans of former Disney Channel star Bridget Mendler
Speaker 9: were thrilled to see she had released a new EP
Speaker 9: titled Once Again, on Spotify and Apple Music, but Mendler
Speaker 9: confirmed on social media that the release it wasn't her,
Speaker 9: raising concerns about streamer's efforts to prevent AI impersonation. Sorry
Speaker 9: to disappoint everyone. The Spotify release wasn't me, wrote Mendler
Speaker 9: on the former Twitter on Wednesday. When it is, trust me,
Speaker 9: you'll know, oh boy. Spotify confirmed that the fakep had
Speaker 9: been removed from the platform. Here's what Spotify spokesperson had
Speaker 9: to say about this quote. Protecting artist's identities is a
Speaker 9: top priority for us, and we continue to invest heavily
Speaker 9: in detection and prevention. Spotify is the only streaming service
Speaker 9: to offer artist profile protection, currently available in beta, which
Speaker 9: lets artists opt in to review and approve or decline
Speaker 9: incoming releases before they go live on their profile unquote,
Speaker 9: which seems like a pretty simple system. Actually, you know,
Speaker 9: a lot of this stuff is complicated, and I always
Speaker 9: worry about people getting caught in the net. For example,
Speaker 9: when we talk about software that can detect AI and
Speaker 9: then either block that track or that content or label
Speaker 9: it as AI and so it's not monetizable on YouTube,
Speaker 9: for example, things like that, I always worry about people
Speaker 9: getting caught in the net, people who are actually making
Speaker 9: quote unquote legitimate content or legitimate music, but they get
Speaker 9: tagged as AI when in fact, for example, if you're
Speaker 9: making music, you know, any modern recording studio has programs
Speaker 9: has software in it that they're working with that uses
Speaker 9: AI in some way, so you know there's there's going
Speaker 9: to be error there. This system seems like it would
Speaker 9: be pretty foolproof, though. If you are a verified artist
Speaker 9: on Spotify, if someone uploads something with your name on it,
Speaker 9: you're going to get an email. I presume this is
Speaker 9: how it works from Spotify saying hey, is this you
Speaker 9: do you approve this, and then you either approve it
Speaker 9: or you deny it, and if you deny it, it
Speaker 9: doesn't go up. That seems like a really simple system,
Speaker 9: but it is in beta and apparently there are already
Speaker 9: problems with it because it did not work for Bridget Mendler. Okay,
Speaker 9: so let me just read that part again. But this
Speaker 9: is from the uh. This is what the spokesperson said.
Speaker 9: The system lets the artists opt in to review and
Speaker 9: approve or decline incoming releases before they go live on
Speaker 9: their profile. So it says here that implies that Mendler
Speaker 9: had not opted in to Spotify's artist profile protection, making
Speaker 9: her an easy target for impersonation. Okay, so she didn't
Speaker 9: opt in the former Wizards of Waverley Place star hasn't
Speaker 9: released new music. Since her four track EP Nemesis in
Speaker 9: twenty sixteen, followed by a single Driving in twenty seventeen. Okay,
Speaker 9: so she hasn't been active. I assume she's doing more acting.
Speaker 9: Maybe I don't know. I don't know anything about her,
Speaker 9: but she hasn't been active in terms of release music
Speaker 9: in almost a decade. So it makes sense. And you know,
Speaker 9: this is a relatively new thing, this artist profile verification,
Speaker 9: So I can see how she would have fallen through
Speaker 9: the cracks here. So it says here in fact, Mendler
Speaker 9: stepped away from the entertainment industry. Oh, she's not even acting.
Speaker 9: She stepped away from the entertainment industry to focus on
Speaker 9: her college education and pursue a career in tech. Oh okay.
Speaker 9: Now she's the co founder and CEO of Northwood Space
Speaker 9: and Aerospace communications startup launched in twenty twenty three. Okay,
Speaker 9: so she's out of the game completely. Given Mendler's pivot
Speaker 9: away from music, it seems she was ripe for Ai impersonation.
Speaker 9: Since she had presumably not opted into Spotify's beta service
Speaker 9: to protect her profile and was not focused on releasing
Speaker 9: new music, her presence was easier to mimic than someone
Speaker 9: actively involved and with a massive following like Taylor Swift
Speaker 9: or Ariana Grande Weather. Spotify's efforts to protect artists with
Speaker 9: artists Profile Protection will ultimately make a difference in curbing
Speaker 9: bad actors remains to be seen, since currently artists must
Speaker 9: opt into the service once the feature enjoys a wider rollout,
Speaker 9: and artists are not required to opt in. Such functionality
Speaker 9: could make a massive difference. Hopefully, Spotify as plans to
Speaker 9: expand the release so that artists like Mendler who aren't
Speaker 9: actively engaging with their streaming presence can rest easy knowing
Speaker 9: they won't be the target of AI deep fakes. Okay,
Speaker 9: I but I have a question, why can't you, like,
Speaker 9: why does it have to be something you have to
Speaker 9: opt in for? It just seems to me, wouldn't it
Speaker 9: not be the easiest thing in the world to just
Speaker 9: make it so that whoever the artist profile is registered to,
Speaker 9: they get And I mean, jeez, we all have two
Speaker 9: step verification now just to log in to our email
Speaker 9: or whatever, right or to social media, Like, there's all
Speaker 9: kinds of stuff now to verify things when you're logging
Speaker 9: into things. Why can't there be something and maybe if
Speaker 9: they opt into the artist's profile protection, maybe there's even
Speaker 9: an additional step. But why can't there be something basic
Speaker 9: where if it's your account, if it's your name, and
Speaker 9: someone is uploading something with your name on it, you
Speaker 9: automatically get an email saying, hey, just making sure this
Speaker 9: is you and that you approve of this. Why does
Speaker 9: it have to be something you have to opt into,
Speaker 9: because again, this is a problem. And you know, I
Speaker 9: thought this sounded like a great idea the first time
Speaker 9: we talked about it on the show, but yeah, there
Speaker 9: is a great giant gaping hole in this whole thing. Right,
Speaker 9: if you're not someone who's actively making new music and
Speaker 9: you're not paying attention to what's going on on Spotify
Speaker 9: because you're you don't have anything new to put there,
Speaker 9: then yeah, then you're ripe for this kind of thing.
Speaker 9: She hasn't put out new music since twenty seventeen, so
Speaker 9: they're gonna have to figure it out and listen again,
Speaker 9: this is in beta, and hopefully they will figure it out.
Speaker 9: But that's that's crazy. So another just quick thing because
Speaker 9: we are running out of time in the first hour.
Speaker 9: But this relates to another thing we talked about recently
Speaker 9: on the show about who owns your voice, and we
Speaker 9: talked about this with that whole that story we did.
Speaker 9: Maybe it was a month ago, the estate of Johnny
Speaker 9: Cash suing Coca Cola because Coca Cola had some commercials
Speaker 9: that there's a guy singing in the commercial that kind
Speaker 9: of sounds a little like Johnny Cash, but to me,
Speaker 9: did not sound enough like Johnny Cash to you know,
Speaker 9: to justify the claim that the estate was making in
Speaker 9: their lawsuit that Coca Cola intentionally hired a sound alike
Speaker 9: singer to fool people into thinking that it was Johnny
Speaker 9: Cash's voice in the commercial. To me, it's somebody singing
Speaker 9: kind of in the style of Donny Caspers. Doesn't sound
Speaker 9: like him. But that opened up a discussion on the
Speaker 9: show about your voice, owning your voice. You know, obviously
Speaker 9: everyone you know, whether you're doing anything creative or not
Speaker 9: or you know, it doesn't matter who you are, you
Speaker 9: own the rights to your own likeness. You know, somebody
Speaker 9: can't just take and use your likeness, a visual image
Speaker 9: of you and just use it for whatever they want to, right,
Speaker 9: That's that's illegal. You own your likeness no matter who
Speaker 9: you are. Whether you're famous not famous, whatever, you own
Speaker 9: your likeness. You own what you create, you own your own.
Speaker 9: If you great music, you own your music. If you
Speaker 9: create something else, you own it. You own that right.
Speaker 9: But what about your voice? What about your voice? And
Speaker 9: there was something that came up on the show several
Speaker 9: months ago. I can't remember the name of the company,
Speaker 9: but Scarlett Johanson was suing a company that had an
Speaker 9: app that they created. They wanted Scarlett Johansson's voice to
Speaker 9: be the voice of the app. She said, no, next thing,
Speaker 9: you know, you can hear her voice on the app
Speaker 9: because apparently they hired an actress who whose voice sounded
Speaker 9: very similar to that of Scarlett Johanson, or at least
Speaker 9: this is what they claimed. But she was claiming that, no,
Speaker 9: they just made an AI generated version of my voice.
Speaker 9: So she sued them and I think she won or
Speaker 9: they settled or something. But who owns your voice? And
Speaker 9: it is tricky. It is tricky because some people sound similar.
Speaker 9: You know, you might think you have a very distinctive voice.
Speaker 9: Nobody else sounds like you. But guess what, there's somebody

Speaker 9: application with the Trademark Office. That's usually for things like,
Speaker 9: you know, you can trademark sounds. I mean, obviously you
Speaker 9: can trademark songs, but you can also trademark other things
Speaker 9: like du that belongs to NBC, that's their you know,
Speaker 9: little song that you might hear at the end of
Speaker 9: a show, or something you know you can. But he's
Speaker 9: actually filing a trademark application, a sound mark application, specifically
Speaker 9: for his voice, it says here in the era of
Speaker 9: voice trademarks upon us. It seems that way as Lionel
Speaker 9: Richie has become the latest entertainment professional to file related
Speaker 9: applications amid AI's rapid expansion. Specifically, Richie moved to obtain
Speaker 9: the trademarks yesterday, joining the likes of Taylor Swift and
Speaker 9: Matthew McConaughey, both of whom have sought voice and Likeness
Speaker 9: trademarks as of late. According to the filings, Richie is
Speaker 9: specifically seeking sound marks for snippets of his famed song
Speaker 9: lyrics Hello is it me? You're looking for say you
Speaker 9: say me? Easy? Like Sunday Morning and all night long. Unsurprisingly,
Speaker 9: all the applications mention a man saying the lyrics and
Speaker 9: connection with, among other things, entertainment, information services, stage performances, interviews,
Speaker 9: and related websites. These specific usages aside, it's not a
Speaker 9: secret that the aforesaid AI, which is pumping out all
Speaker 9: manner of sound alike and look like media, played a
Speaker 9: key part in Richie submitting the applications. But will they
Speaker 9: receive USPTO approval? If so, how exactly would the four
Speaker 9: time Grammy winner look to protect his IP intellectual property
Speaker 9: undercurrent trademark law. See, we're in't a whole new realm here.
Speaker 9: There's a lot of lawyers. But boy, what a great
Speaker 9: time to be an attorney. They're going to make a
Speaker 9: lot of money in the AI era. Admittedly, again getting
Speaker 9: back to the article here, admittedly we lack definitive answers
Speaker 9: here on the former front. Gurban Ip pointed to the
Speaker 9: possibility of Richie and others encountering significant legal hurdles with
Speaker 9: the here to four Little Seeing applications. A few adjacent questions,
Speaker 9: as these applications are seeking to protect actual voices. What
Speaker 9: happens when and this is my question that I keep raising,
Speaker 9: what happens when similar sounding entertainers come along? Is this
Speaker 9: a first come, first served situation that will leave future
Speaker 9: generations out of luck? And what of existing voice overlap
Speaker 9: among public figures generally? Nevertheless, McConaughey has already secured several
Speaker 9: trademarks is Hey Hey Hey application was filed back in
Speaker 9: twenty twenty three. Furthermore, despite the enforceability questions, it's always
Speaker 9: possible that voice and likeness trademarks will prove useful in
Speaker 9: courtroom confrontations down the line. That ties back to another
Speaker 9: unknown how the NIL focus will evolve in the approaching
Speaker 9: years between the AI and music related music investment explosions.
Speaker 9: It seems safe to say that there's never been a
Speaker 9: bigger emphasis on the rights. Time will tell how this
Speaker 9: and the corresponding trademark process evolves in the coming years.
Speaker 9: There's also the chance that Congress will update voice and
Speaker 9: Likeness law for the AI era. What can go wrong?
Speaker 9: A modified version of the No Fakes Act, the prior
Speaker 9: iteration of which sputtered out in committee, was introduced last month.
Speaker 9: By the way, just a quick sidebar on that before
Speaker 9: we wrap this up, because we do need to show

Speaker 9: look up, look up Mark Zuckerberg testifies before Congress or whatever.
Speaker 9: And listen to the questions these people ask, and you
Speaker 9: will immediately And I'm not saying all of them, by
Speaker 9: the way, some some are well informed and ask good questions,
Speaker 9: but some don't. And you will immediately become concerned. I
Speaker 9: promise you. If this is not your reaction, there's something
Speaker 9: wrong with you. You should immediately become concerned about. You know,
Speaker 9: some of these, you know, septagenarian octogenarian people. Not to
Speaker 9: be agist, but some of the questions that they ask.
Speaker 9: When you realize that these are the people who are
Speaker 9: going to make laws about something that they don't and
Speaker 9: cannot and will not ever understand. When you listen to
Speaker 9: some of the questions and how confused they are, it's
Speaker 9: it always makes me so nervous. So maybe it's just
Speaker 9: as well that the no fakes act. Well, it might
Speaker 9: be something that I would support in theory and spirit
Speaker 9: and judgment, but maybe it's just as well that it's
Speaker 9: sputtered out because who knows what was actually in it
Speaker 9: and uh, and there's probably a bunch of things in
Speaker 9: it that didn't even apply to the problem at hand,
